PAIA and Access to Information Policy

Purpose of this policy

This PAIA and Access to Information Policy explains how requests for access to records may be handled by Dr Lerissa Pillay Specialist Paediatrician in line with South African access to information principles.

What PAIA is

The Promotion of Access to Information Act, 2000, known as PAIA, gives effect to the right of access to information and sets out processes for requesting records from public and private bodies, subject to legal requirements and limitations.

Records that may be held

The practice may hold administrative records, website enquiry records, appointment-related records, patient-related records, supplier records, legal or compliance records and communication records. The existence of a record does not automatically mean it can be disclosed.

Who may request access

Patients, parents, legal guardians, authorised representatives or other parties may request access to information where they have a lawful basis. The practice may require proof of identity, authority or legal entitlement before processing a request.

How to make a request

Requests should be sent in writing to info@northcoastpaediatrics.co.za with enough detail to identify the requester, the record requested, the reason for the request where required, and the preferred method of access.

Verification before disclosure

Before releasing any record, the practice may verify identity, authority, consent and legal entitlement. This is especially important for child information, medical information and information involving more than one person.

Grounds for refusal or limitation

Access may be refused, delayed or limited where disclosure would breach privacy, confidentiality, legal privilege, third-party rights, professional duties, safety obligations or other grounds allowed by law.

Fees and preparation

Where permitted by law, a request fee, access fee, reproduction fee or preparation fee may apply. The requester may be informed of any applicable fees before the request is processed or records are provided.

Response and escalation

The practice will aim to respond within applicable legal or reasonable timeframes. If a requester is dissatisfied with the outcome, they may have the right to complain to the Information Regulator or use other remedies available under law.

Relationship with POPIA

Requests for access to personal information may also involve POPIA rights. The practice should handle access requests in a way that balances the requester’s rights with privacy, confidentiality and protection of other people’s information.
